RE: The tariff classification of steel frame gazebos from China

Dear Ms. Liu:

In your letter dated June 15, 2012 you requested a tariff classification ruling.

The product to be imported is described as item number A050MA00477, a grill gazebo with glass grill bars. The product is composed of 80 percent steel comprising the frame, 10 percent polyester comprising the roof, and 10 percent glass comprising the grill tops. The assembled gazebo is approximately 8 feet in height and 5 feet each in width and depth. There are four steel legs forming the corners of the gazebo, with a decorative framework connected to the tops of the legs and a 180 gauge polyester roof cover attached to the top of the framework. In addition there are two glass grill bar tops or shelves, 9 inches in width, attached midway up the two sets of steel legs, extending the distance between each set of legs in length.

The applicable subheading for the steel framed grill gazebo will be 7308.90.9590, Harmonized Tariff Schedule of the United States (HTSUS), which provides for structures (excluding prefabricated buildings of heading 9406) and parts of structures (for example, bridges and bridge sections, lock gates, towers, lattice masts, roofs, roofing frameworks, doors and windows and their frames and thresholds for doors, shutters, balustrades, pillars and columns) of iron or steel; plates, rods, angles, shapes, sections, tubes and the like, prepared for use in structures of iron or steel: other, other, other, other, other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
